Government response to measures relating to the land-based gambling sector
There has also been a decline in gaming machine usage in alcohol licensed premises. Gaming machines are currently permitted in a variety of locations and divided into various categories based on factors such as maximum stake and prize available, as well as the premises where they may be used. We will use the responses to this consultation as well as wider engagement with the sector to gather data to estimate the likely change in machine configuration in bingo and arcade venues. In making this recommendation we recognise the potential advantages that 1968 Act casinos may have over Small 2005 Act casinos that elect to move to the new regime, in terms of Schedule 9 payments and the portability of licences. Currently, 1968 Act casinos are not required to have a table gaming area so the premises plan will need to be updated accordingly. It will not be possible for a licensee to rely on an ancillary remote betting licence, even where the SSBT offer is alongside a non-remote offer as the ancillary licence is bound to a betting premises licence. This measure will also bring greater consistency to the different licensing regimes and greater parity between online and land-based casinos. These products do not count as gaming machines, but neither do they provide any of the benefits of a multiplayer table in contributing to a balanced mix or affording opportunities for social interaction.
Are there any specific licensing or operational requirements for operators accepting digital currencies (including cryptocurrencies)? Multi-operator self-exclusion schemes are in place to allow consumers to self-exclude from multiple gambling premises in Great Britain. Since 28 February 2025, remote operators have been required to undertake financial vulnerability checks once a customer’s net spend exceeds £150 in a rolling 30-day period.Operators are expected to have in place measures to detect self-excluded persons who might wish to re-register using different details. This will act as a safeguard in case someone tries to put more than £100 onto the machine. Some responses stated it should be £1, in line with their view that cashless payments should not be permitted at all.
However, it is our intention to apply a fixed maximum of 80 gaming machines per physical location. The government proposes that a new regime will apply to 1968 Act casinos that seek to increase their gaming machine entitlement. There were mixed views on casinos’ ability to hold multiple licences at the same physical location. It was proposed that the requirements would form part of a new regime that operators would have the option of moving onto, taking up a new gaming machine entitlement under the new rules. Over half of respondents who indicated an intention to move onto the new regime stated they would look to take up the maximum entitlement of 80 gaming machines in at least some of their venues (57%).

These respondents also suggested that increasing the availability of gaming machines will not make customers more likely to take breaks, due to the prospect of other customers taking over their machine and claiming their ‘perceived winnings’. This opposition was primarily from industry stakeholders, who argued that the other space requirements and the imposition of a machine to table ratio would ensure a balance between table gaming, machines and non-gambling space. The casino measures section of the consultation received 41 responses from a variety of stakeholders, including gambling operators and trade bodies, local government organisations, campaign groups and academics.
Licensing fees vary by premises type. Therefore, the proposals set out in this chapter will only apply to licensing authorities in England and Wales. However, it should be noted that respondents were most likely to have spent their own money on types of gambling activity that are legal or do not feature age restricted products, such as penny pusher or claw grab arcade games. Bacta’s members make up approximately 70-80% of the market for family entertainment centres and adult gaming centres. The Gambling (Premises Licence Fees) (England and Wales) Regulations 2007 established the maximum level of fees that local authorities in England and Wales can charge for gambling premises licences. As set out in the white paper, we believe that a more precautionary approach is justified for slot-style games which mirror the mechanics of adult-only gaming machines, particularly those which pay out cash. Should there be voluntary limits (the ability for customers to set time and monetary thresholds) on gaming machines accepting direct cashless payments? This standard applies to feasible B3 gaming machines and provides players with a 30 second cooling-off period once voluntary limits are hit.
The vast majority of responses stated that specific safer gambling messaging should be considered within cashless gambling. We do not propose that staff alerts are required for Category D machines that accept direct debit card payments. However, we think that this is an important tool that staff could use to monitor players and therefore, it should be a feature on Category B and C machines accepting cashless payments.
As a result, these venues will be entitled to choose between adopting any revised entitlement set down in legislation following this consultation or retaining the four Category B machine allowance for AGC premises and eight Category B machine allowance for bingo premises. The proposals outlined in this consultation to reform the 80/20 rule will again permit AGC and bingo premises to retain these legacy rights where the relevant premises licence was granted before 13 July 2011. Further information about premises licence fees are outlined in Chapter 5. The Gambling Commission will also need to be notified of an operator’s projected annual licence fee category based on GGY for the forthcoming licence period, so that the correct fees can be paid.
